Introduction

We at SocialPiper Inc. (“SocialPiper,” “we,” “our” or  us” respect your privacy and are committed to protecting it and your personal information through our compliance with this privacy policy (“Privacy Policy”).  This Privacy Policy describes how we handle and protect your personal information in connection with our business activities such as client services, and on sites, applications and communications that post a link to this Privacy Policy.

We collect your personal information through our Sites, mobile applications, email and social media. “Personal Information” is information that can be used to trace or distinguish an individual’s identity, either alone or when combined with other personal or identifying information that is linked or linkable to a specific person, such as name, postal address, e-mail address, telephone number, or other information.

This Privacy Policy explains to you what we do with your personal information, and describes the types of information we may collect from you or that you may provide when you visit our website www.SocialPiper.com (together with related webpages, our “Website”), apps or other platforms in our control (collectively, “Sites”).  This Privacy Policy also describes practices for collecting, using, maintaining, protecting, and disclosing that information.

This Privacy Policy applies to information we collect:

  • On this Website and any of our Sites;
  • Through software applications made available by us for use on or through computers and mobile devices (“apps”);
  • Through our social media pages;
  • In email, text, and other electronic messages between you and our Sites;
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this Privacy Policy.
         

It does not apply to information collected by:

  • us offline or through any other means, including on any other Sites operated by SocialPiper or any third party (including our affiliates and subsidiaries); or
  • any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Sites.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Sites. By accessing or using any of our Sites, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see “Changes to Our Privacy Policy”). Your continued use of our Sites after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates.

Our Services

SocialPiper offers a suite of professional social media management tools that are accessible via our Sites. These tools allow you to bring together certain of your professional social media accounts for easy access and management through a single online portal and may provide from time to time additional services. Through this portal, you can manage your professional social media, marketing, and advertising campaigns; engage with your audiences; schedule and publish messages; and analyze the results of these activities. Collectively, we refer to these tools as our “Services.”

Any collection, use, and management of personal information by the social networks we support, which are currently FaceBook, Instagram and Twitter (collectively, the “Social Networks”) are governed by their respective privacy policies and terms. When using Social Networks, you are required to comply with their privacy policies and terms. We recommend you carefully review their privacy policies and terms, as SocialPiper is not responsible for the Social Networks.

Our Services also enable you to customize and connect your SocialPiper account to third-party services (“Third-Party Services”), including through apps you can access on your computer or other electronic device(s) or which may be available to you via our portal/dashboard. The collection of your information by these third parties is governed by the Third-Party Services’ privacy policies and terms. we recommend you carefully review their privacy policies and terms, as SocialPiper is not responsible for Third-Party Services.

Children Under the Age of 18

Our Sites and Services are not intended for, designed for or directed for use by children under the age of 18, and should only be accessed by individuals who are at least 18 years old and are using the Sites and Services for business purposes. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on any of our Sites or on or through any of its features, register on our Sites, make any purchases through our Sites, use any of the interactive or public comment features of our Sites or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information.  SocialPiper does not intentionally collect or maintain personal information about anyone under this age.   If you believe we might have any information from or about a child under 18, please contact us at privacy@socialpiper.com.

Information Collected

When you browse our Sites and/or use our Services, we collect several types of information from and about users of our Sites, including information:

  • information about your business representative’s or your business such as contact and profile information including your or your business representative’s name, email address, organization name, and address (collectively, “Business Information”);
  •     that is about you but individually does not identify you; and/or
  • about your internet connection, the equipment you use to access our Sites and usage details.

Personal Information is any information that is in our possession or control that can be used to identify you or link to you. Business Information and Personal Information are collectively referred to generally as “personal information” in this Privacy Policy.

More specifically we collect the following:

Browsing our Sites

When you browse any of our Sites, we collect information about you as described below, some of which is collected automatically:

  • When you use automated chat functionality (chatbots) to make an inquiry or other request, we may collect information about you such as your name and email address, your specific request, and information related to your use of our Services.
  • SocialPiper and our Third-Party Services providers use cookies and other similar tracking technologies on our Sites and Services including web beacons, pixels, and software tokens. These are described in our Cookie Policy.
  • Aggregated Site usage data including form analysis data (such as time taken to complete the form), engagement rate, session replay, and mouse movements.  If you wish to opt out of this collection, please contact us at privacy@socialpiper.com.

Account information

  • Your contact and profile information including your name, email address, organization name, and address; your preferences such as language, time zone, and the types of communication you would like to receive from us; and image (if you choose to provide this). We may also obtain this information if you choose to use a social login service, such as FaceBook Login, to create or access your account.
  • Billing and other payment information (if you sign up for a paid service or purchase a Third-Party Service), including payment method details, such as credit card number(s).
  • The Services you have acquired from us, including the type of plan, number of team members, and transaction information related to the Services.

Content

  • Your social profile information for Social Networks you choose to connect to the Services. For example, your FaceBook profile information may include your FaceBook username and profile image.
  • A specific location such as an address, a city, or a place (for example, a restaurant) if you choose to share this information.
  • Your messages, posts, comments, images, advertising, and other material you curate on and upload to the Services; and information that is collected from the Social Networks that you choose to connect to, and which is displayed on our Services.
  • Content that you may send and receive through Social Networks may contain personal information that SocialPiper does not directly collect or process. This may include information such as: names, photos, age, gender, geographic location, opinions, preferences, and phone numbers.

Logs, usage, and support data

  • Log data, which may include your IP address, the address of the web page you visited before using the Services, your browser type and settings, your device information, the date and time when you used the Services, information about your browser configuration, language preferences, unique identifiers, and cookies.
  • Your log-on credentials to Social Networks and/or other Third-Party Services. For example, your user name and password to FaceBook.
  • Usage data and analytics, which may include the frequency of login, and the different types of activity undertaken by users.
  • General Location information, such as IP address and the region in which you are located when you are logging in and using the Services.
  • Customer support questions, issues, and general feedback that you choose to provide.

How We Collect Information

We collect information directly from you, automatically as you navigate through the Sites using tracking technologies, and from third parties, as follows:

Information You Provide to Us

The information we collect on or through our Sites may include:

  • Information that you provide by filling in forms on our Sites. This includes information provided at the time of registering to use our Sites, subscribing to our Services, posting material, or requesting further services. We may also ask you for information when you report a problem with our Sites.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.
  • Details of transactions you carry out through our Sites and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Sites.
  • Your search queries on the Sites.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Sites, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Sites, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Sites.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.          

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Contact our team at privacy@socialpiper.com for information on how you can opt out of behavioral tracking on our Sites and how we respond to web browser signals and other mechanisms that enable consumers to exercise choice about behavioral tracking.

The information we collect automatically may include personal information, and/or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Sites and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Estimate advisable times to publish content.
  • Estimate suggested amount of money, during a certain period of time, to spend on FaceBook, Twitter and/or other advertising.
  • Store information about your preferences, allowing us to customize our Sites according to your individual interests.
  • Speed up your searches.
  • Recognize you when you return to our Sites.

The technologies we use for this automatic data collection may include:

    • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Sites.     • Flash Cookies. Certain features of our Sites may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Sites. Flash cookies are not managed by the same browser settings as are used for browser cookies.   • Web Beacons. Pages of our Sites and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the SocialPiper, for example, to count users who have visited those pages or opened an email and for other related Sites statistics (for example, recording the popularity of certain Sites content and verifying system and server integrity).

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the Sites are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Sites. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. This Privacy Policy does not apply to those Sites, which may have their own privacy policies and notices which you should read to understand how they may collect and use your personal information.  SocialPiper is not responsible for the content or privacy practices of any linked Sites we do not control.

Do Not Track Signal

Note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit.  There is no consensus among industry participants as to what “Do Not Track” means in this context.  SocialPiper, like many websites and online services, currently does not alter its practices when we receive a “Do Not Track” signal from a visitor’s browser.  To find out more about “Do Not Track,” you are encouraged to visit https://allaboutdnt.com/.

Lawful Basis for the Processing of Your Information

We only collect and use Personal Information where we have legal grounds to do so.  This includes processing Personal Information to provide requested Services, for purposes of SocialPiper’s legitimate interests in promoting and protecting SocialPiper, building and maintaining relationships, recruitment and providing our Services, to fulfill our legal obligations in complying with the law or on the basis of consent.

How We Use Your Collected Information

We use your information that we collect or that you provide to us, including any Business Information and personal information:

    • To present our Sites and its contents to you.
    • To provide you with information, products, or Services that you request from us or that we want to share with you.
    • To fulfill any other purpose for which you provide it.
    • To access Third-Party Services and Social Networks on your behalf.
    • To provide you with notices about your subscription, including expiration and renewal notices.
    • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
    • To notify you about changes to our Sites or any products or services we offer or provide though it.
    • To allow you to participate in interactive features on our Sites.
    • To improve our Sites and/or Services.
  • To promote and advertise our Sites and Services.  For example, we use the information collected from you for the purpose of sending you direct promotional marketing emails or messages (see “Direct Marketing” below) to show you information or SocialPiper Services that may be of interest to you, and other promotional materials and events.
  • To send promotional communications to you regarding third-party services, products, promotions and/or offers.
  • To enforce our Terms of Service.
  • To contact you as requested by you or otherwise approved by you.
  • To operate our business, which may include analyzing our performance, meeting our legal obligations, developing our workforce, and doing research.
  • In any other way we may describe when you provide the personal information.
  • For any other purpose with your consent.

Direct Marketing

We use your personal information to send you direct marketing communications about SocialPiper products, Services or promotions from time to time that may be of interest to you or our related services. This may be via email, post, SMS, telephone or targeted online advertisements.

In most cases our processing of your personal information for marketing purposes is based on our legitimate interest, although some cases (such as where required by law) will be based on your consent. You have a right to prevent direct marketing of any form at any time – this can be exercised by sending an email to privacy@socialpiper.com.

We take steps to limit direct marketing to a reasonable and proportionate level, and to send you communications which we believe may be of interest or relevance to you, based on the information we have about you.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Promotional Offers from SocialPiper. If you do not wish to have your email address/contact information used by SocialPiper to promote our own or third parties’ products or services, you can opt-out by contacting us at privacy@socialpiper.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to SocialPiper as a result of a product purchase, warranty registration, product service experience or other transactions.
  • Outside Parties. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s Sites.

Security: Safeguarding Your Information

We take great care in maintaining the security of our Site and your information and in preventing unauthorized access, loss, misuse, alteration, destruction or damage to it through industry standard technologies and internal procedures. Only authorized SocialPiper personnel and Third-Party Services providers are provided access to personal information, and these employees and Third-Party Services providers are required to treat this information as confidential. Among other things, we regularly maintain a PCI DSS (Payment Card Industry Data Security Standards) certification (with respect to payment by credit cards). In addition, we contractually ensure that any third party processing your personal information equally provide for confidentiality and integrity of your data in a secure way.  Despite these precautions, however, SocialPiper cannot guarantee that unauthorized persons will not obtain access to your personal information.  The transmission of data over the internet is not completely secure and although we do our best to protect your personal information, we cannot guarantee the security of your information transmitted to our Site. So, you use our Sites and provide us with your information at your own risk.  Our employees and Third-Party Services providers are required to keep information covered by this Privacy Policy confidential – unless disclosure is permitted in this Privacy Policy or by you.  We will retain your personal information for as long as reasonably necessary to comply with legal obligations or for no longer as required for legitimate business purposes.

SocialPiper maintains industry standard security safeguards to protect your information. This includes ensuring our employees receive appropriate security and privacy training and guidance, so they are aware of the measures they need to implement to protect your information.

Access controls are in place to limit access to your information to those who need it to perform their jobs. For example, information about you may be provided to our customer support specialists to help you with your requests. Individuals who are permitted to handle your information must adhere to confidentiality obligations.

We encrypt data where appropriate to ensure that your information is kept private. We undertake vendor security and privacy reviews to ensure that vendors follow our stringent requirements to safeguard your information, and we also enter into data protection agreements with our vendors. All payment information is fully encrypted and handled only by PCI certified organizations.

Accessing and Correcting Your Information

You can review and change your personal information by logging into the Sites and visiting your account profile page.

  • You may also send us an email at privacy@socialpiper.com to request access to, correct or delete any Business Information or Personal Information that you have provided to us. We cannot delete your information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

         If you delete your content from the Sites, copies of your content may remain viewable in cached and archived pages or might have been copied or stored by other Sites users. Proper access and use of information provided on the Sites, including user content, is governed by our Terms of Service.

Your Rights

Services

When using our Services, you may access, update, or correct most of your Account information by logging in to your account to edit your profile or organization record.

If you have requests that cannot be carried out by logging in to your account, such as accessing additional information or deleting information about you, please email our team at privacy@socialpiper.com. Please note that we may need to retain certain information about you for as long as you maintain an account for our Services, to provide you with our Services, for record keeping purposes, for payment processing, to comply with our legal and regulatory obligations, to resolve disputes, or to enforce the applicable terms of service or other agreement in place between you (or your organization) and SocialPiper (the “Terms of Service”).

Requests to access, correct, or delete your information will be handled within thirty (30) days unless they are unusually extensive or complex, in which case we will advise you of the expected timeline for handling your request.

Our Services retrieve and display content from Social Networks. Beyond temporary storage for performance reasons, we do not store content unless you take specific action in relation to such content (such as using our Services to prepare draft content for publication on Social Networks). In some cases, content may continue to exist on the Social Networks even after you or we delete it from our Services, and you will need to contact the relevant Social Network directly if you want it to delete this content.

Marketing emails, advertising and Sites browsing

For marketing communications, you may opt out of marketing communications sent by SocialPiper by requesting it at privacy@socialpiper.com, or by clicking on the unsubscribe link in the marketing email you receive.

Access to your information

SocialPiper does not rent or sell your information. We restrict access to your information to authorized employees and staff and we do not share your information with third parties except in the circumstances explained below.

Employees and Authorized Contractors

Our employees and authorized contractors may need to access information about you when they require this to perform their jobs. For example, a customer support representative would need access to your account to validate your identity and respond to your question or request; our email communications team would need access to your contact information to ensure this information is sent correctly and any unsubscribe requests are properly managed; and our security staff would need to review information to investigate attempted denial of service attacks, fraudulent account activity, or other attempts to compromise the Services.

All our employees and contractors are required to agree to maintain the confidentiality and protect the privacy of your information.

Third-Party Services Providers, Authorized Resellers, and Partners

We will share limited information about you to authorized service providers we use for marketing services, communicating with you, managing our customer database, the provision of professional services, and providing and managing the Services (including hosting data centers, securing our Services, and payment processing). The Third-Party Services providers we use to help us deliver the Services are referred to as “sub-processors” and are listed here.

Where you have purchased a service from an authorized reseller or partner, we may provide information about you to (and may receive information about you from) the reseller or partner as necessary to support your use of the service you purchased.

When sharing your information with any of these Third-Party Service providers, resellers and partners, we ensure they agree to obligations consistent with this Privacy Policy and any other appropriate confidentiality and security measures, and only use your information to carry out the Services and your requests.

Social Networks and Third-Party Services

Where you are using our Services and have chosen to connect your Social Networks to the Services, or if you authorize a Third-Party Service to access your account (including the third party payment processor(s) we may elect to use), you are agreeing to provide information about you to the Social Networks and the Third-Party Services under their respective terms and privacy policies, including payment information.  This Privacy Policy does not apply to those websites, which may have their own privacy policies and notices which you should read to understand how they may collect and use your personal information, business information or other information.  SocialPiper is not responsible for the content, terms or privacy practices of any such Social Networks and Third-Party Services providers.

Customer Organizations

Where your employer or an entity has purchased Services on your behalf, we may disclose information about you such as your name and email address, and some usage information including whether a user has logged in to the Service, frequency of login, time spent using the Services, and any other use of the Services to assist your employer or the entity in managing its use and maximizing the value of the Services.

Successor Entities

If we are acquired by or merge with another entity (in which case we will require such entity to assume our obligations under this Privacy Policy), if we are involved in a bankruptcy, or if the ownership or control of all or part of our Services or their assets changes, information about you will be transferred to such entities.

Law Enforcement, Government Agencies, and Professional Advisors

We may need to disclose information about you where we believe that it is reasonably necessary to comply with a law or regulation, or if we are otherwise legally required to do so, such as in response to a court order or legal process, or to establish, protect, or exercise our legal rights or to defend against legal claims or demands.

In addition, we may be required to disclose information about you if we believe it is necessary to investigate, prevent, or take action: (a) against illegal activities, fraud, situations involving potential threats to our rights or property (or to the rights or property of those who use our Services), or to protect the personal safety of any person; or (b) regarding situations that involve the security of our Services, abuse of the Services infrastructure, or the Internet in general (such as voluminous spamming, or denial of service attacks).

Data Transfers

SocialPiper’s Services and Sites are operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States.  Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Services or our Sites you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than those of your country.

GDPR and International Regulations

Information for Users Outside of the United States

Under the General Data Protection Regulation (“GDPR”) and other data protection laws, information about you may only be transferred from your region to other regions if certain requirements are met. For instance, under the GDPR, information about you may be transferred from the European Economic Area (“EEA”) to outside the EEA if adequate data protections are in place. Our Services are managed by SocialPiper’s headquarters located in California, United States. So, your personal information may be transferred to, stored or processed in the United States.  By its nature, social media data can be shared with people around the globe. The Social Networks and Third-Party Services that you choose to integrate with our Services may collect, store, and process your information from various locations around the world according to their own terms and privacy policies.

If you are visiting our Sites from outside of the United States, please be aware that the information we obtain about you will be processed in the United States or in other jurisdictions. By using our Sites, you agree that any personal information which you provide will be treated in accordance with the laws of the United States.  In addition, you acknowledge that and consent to the international transfer and processing of your personal information as described in this Privacy Policy. Please know that the data protection laws and regulations that apply to your personal information transferred to the United States or to other countries may be different from the laws in your country of residence.

Rights of European Users and Data Subjects

Under applicable EU regulation, you have the following rights with regards to your personal information:

  • to obtain a copy of your personal information together with information about how and on what basis that personal information is processed;
  • to rectify inaccurate personal information;
  • to erase your personal information in limited circumstances where (a) you believe that it is no longer necessary for us to hold your personal information; (b) we are processing your personal information on the basis of legitimate interests and you object to such processing, and we cannot demonstrate an overriding legitimate ground for the processing; (c) where you have provided your personal information to us with your consent and you wish to withdraw your consent and there is no other ground under which we can process your personal information; and (d) where you believe the personal information we hold about you is being unlawfully processed by us;
  • to restrict processing of your personal information where: (a) the accuracy of the personal information is contested; (b) the processing is unlawful but you object to the erasure of the personal information; (c) we no longer require the personal information for the purposes for which it was collected, but it is required by you for the establishment, exercise or defense of a legal claim or (d) you have objected to us processing your personal information based on our legitimate interests and we are considering your objection;
  • to challenge processing which we have justified on the basis of our legitimate interest;
  • to object to decisions which are based solely on automated processing or profiling;
  • where you have provided your personal information to us with your consent, to ask us for a copy of this data in a structured, machine-readable format and to ask us to share (port) this data to another data controller; or
  • to obtain a copy of or access to safeguards under which your personal information is transferred outside of the EEA.

We will ask you for additional data to confirm your identity and for security purposes, before disclosing personal information requested to you. We reserve the right to charge a fee where permitted by law. We will decline to process requests that jeopardize the privacy of others, are extremely impractical, or would cause us to take any action that is not permissible under applicable laws. Additionally, as permitted by applicable laws, we will retain where necessary certain personal information for a limited period of time for record-keeping, accounting and fraud prevention purposes.

Your Right to Lodge a Complaint

You have a right to lodge a complaint concerning our processing of your Personal Information with your national (or in some countries, regional) data protection authority. Retention of Information

We retain your Personal Information, as necessary, and only as long as required to provide the Services requested by you, for record keeping purposes, to comply with our legal obligations, resolve disputes, for analytics, and to enforce the terms for the Services.  How long we retain Personal Information varies depending on the type of information and for the purpose for which it is used.  We delete Personal Information within a reasonable period after we no longer need to use it for the purpose for which it was collected (or for any subsequent purpose that it compatible with the original purpose.)
